These Terms and Conditions of Sale (hereinafter referred to as the “Terms of Sale” or “T&Cs”) govern the sale of products offered by Tovia to customers through its online store.

By placing an order, the customer acknowledges having read and accepted these Terms of Sale.

These Terms apply to all purchases made through the online store, subject to mandatory consumer protection laws.

ARTICLE 2 – SCOPE OF APPLICATION

These Terms of Sale govern the contractual relationship between Tovia and customers purchasing products through the online store.

They define the rights and obligations of both parties concerning ordering, payment, delivery, returns, refunds, warranties, and dispute resolution.

These Terms are made available to customers before completing a purchase.

ARTICLE 3 – PRODUCTS

Tovia offers watches, accessories, and other products listed in its online catalog.

Each product is presented with a description of its main characteristics, available variations, and price.

We make reasonable efforts to ensure that product photographs, descriptions, and specifications accurately represent the items offered.

Minor visual differences may occur due to lighting, photography, or screen settings. Such differences do not affect customers' statutory rights if a product does not conform to its description.

ARTICLE 4 – PRICES

Product prices are displayed during the shopping process and confirmed before payment.

ARTICLE 8 – SHIPPING AND DELIVERY

Estimated delivery times vary according to the destination and shipping method.

Indicative delivery estimates after dispatch are:

These estimates do not include order processing time.

Delivery estimates are indicative unless a specific delivery deadline is expressly agreed.

Where applicable, statutory delivery deadlines and consumer remedies take precedence.

Once dispatched, tracking information will be provided when available.

The risk of loss or damage generally transfers to the consumer when the consumer, or a third party designated by them other than the carrier, takes physical possession of the goods, subject to applicable law.

ARTICLE 9 – CUSTOMS DUTIES AND IMPORT TAXES

International deliveries may be subject to customs inspections, import duties, local taxes, or clearance charges.

Where legally permitted and clearly disclosed before purchase, such charges may be payable by the customer.

Customs processing times are determined by the relevant authorities and may affect delivery.

Tovia remains responsible for its contractual obligations and mandatory consumer rights despite any involvement of third-party logistics providers.

ARTICLE 10 – ORDER MODIFICATIONS AND CANCELLATIONS

Customers wishing to modify or cancel an order should contact customer support as soon as possible.

Orders that have not yet been dispatched may be eligible for cancellation or modification.

Once an order has shipped, it may no longer be possible to intercept the package or modify the shipment.

This does not affect the customer's statutory right of withdrawal or other mandatory rights.

ARTICLE 11 – RIGHT OF WITHDRAWAL

In accordance with applicable French and European consumer law, eligible consumers generally have 14 days from receipt of the goods to withdraw from an online purchase without giving a reason.

To exercise this right, customers must notify Tovia of their decision to withdraw within the statutory period.

The customer must return the products within 14 days after communicating the withdrawal, unless otherwise agreed.

The customer may be responsible for direct return shipping costs where this responsibility was properly disclosed before purchase and where permitted by law.

Refunds under the statutory withdrawal right will include eligible payments and standard delivery costs in accordance with applicable law.

Tovia will reimburse the customer within the statutory timeframe and may defer reimbursement until the returned goods are received or proof of their dispatch is provided, where legally permitted.

Certain legally recognized exceptions to the withdrawal right may apply.

ARTICLE 12 – VOLUNTARY 30-DAY RETURN POLICY

In addition to mandatory statutory rights, Tovia offers an eligible 30-day return period from the date of delivery.

For voluntary returns, products should generally be:

  • Unused and unworn.

  • In their original condition.

  • Accompanied by original packaging and accessories.

  • Supported by proof of purchase.

These conditions do not restrict statutory withdrawal rights or remedies for defective goods.

Customers must contact customer support before returning products to receive the correct return instructions.

The return warehouse may be located outside the customer's country of residence.

ARTICLE 13 – REFUNDS

Approved refunds are issued to the original payment method unless otherwise agreed in accordance with applicable law.

For voluntary returns, refunds are generally processed after the returned product has been received and inspected.

For statutory withdrawal, the applicable legal reimbursement deadlines and requirements take precedence.

Once a refund has been issued, the time required for it to appear in the customer's account depends on the payment provider or financial institution.

Customers will be informed when their refund has been processed.

ARTICLE 14 – DEFECTIVE, DAMAGED, OR INCORRECT PRODUCTS

If a product arrives defective, damaged, incomplete, or different from the item ordered, the customer should contact customer support.

We may request reasonable supporting information, including photographs or a short video, to help assess the issue.

Depending on the circumstances and applicable legal requirements, Tovia may provide:

  • Repair.

  • Free replacement.

  • Partial refund.

  • Full refund.

For confirmed nonconforming goods, remedies will be provided without costs to the consumer where required by law.

Nothing in these Terms limits statutory consumer guarantees.

ARTICLE 15 – LEGAL GUARANTEES

Consumers benefit from the mandatory legal guarantees provided under applicable French law, including the legal guarantee of conformity and the guarantee against hidden defects.

Legal Guarantee of Conformity

For goods covered by French consumer law, consumers generally benefit from a two-year legal guarantee of conformity from delivery, subject to applicable statutory conditions.

Consumers may be entitled to repair or replacement and, in legally defined circumstances, a price reduction or termination of the contract.

Guarantee Against Hidden Defects

Under applicable French Civil Code provisions, consumers may also have rights concerning hidden defects that render a product unsuitable for its intended use or significantly reduce its usefulness.

These statutory guarantees apply independently of any voluntary commercial warranty.

ARTICLE 16 – PRODUCT CARE AND USE

Customers should follow product instructions and use products in accordance with their stated specifications.

For watches, customers should observe any instructions relating to movement operation, winding, bracelet adjustment, water exposure, and general maintenance.

Product water resistance and other technical characteristics depend on the specific model.

Improper handling, accidental damage, or unauthorized modification may affect eligibility for voluntary commercial warranty coverage, without limiting mandatory statutory rights.

ARTICLE 17 – CUSTOMER OBLIGATIONS

Customers agree to provide accurate information when placing an order.

Customers should review their selected product, model, size, color, and shipping address before confirming payment.

Customers must not use the store for fraudulent or unlawful purposes.

Any suspected transaction irregularity may be reviewed using reasonable fraud-prevention procedures, subject to applicable law.

ARTICLE 18 – PAYMENT DISPUTES AND CHARGEBACKS

Customers experiencing an order issue are encouraged to contact Tovia customer support so that an appropriate resolution can be explored.

If a payment dispute or chargeback is initiated, Tovia may provide the payment provider with relevant order documentation, shipping records, and customer communications.

Where a payment dispute is active, refunds may need to be coordinated with the payment provider to prevent duplicate reimbursement.

Customers retain their lawful rights to dispute transactions with their bank or payment provider. These Terms do not require customers to waive such rights.

ARTICLE 19 – LIABILITY

Tovia is responsible for performing its contractual obligations in accordance with applicable law.

To the extent legally permitted, Tovia is not responsible for damage caused by misuse of products or circumstances legally qualifying for exemption from liability.

Nothing in these Terms excludes or limits mandatory consumer protections, statutory guarantees, or liability that cannot lawfully be excluded.

Personal information collected during the ordering process is processed in accordance with applicable data protection laws, including the GDPR where applicable.

Customer information may be used for order processing, shipping, customer service, fraud prevention, and compliance with legal obligations.
